Terms and Conditions for PBO Online Logbook

1. Introduction

Welcome to the PBO Online Logbook (the "Service"). The Service is operated by bryanzcom ("we", "our"). Please read these Terms and Conditions carefully. They serve as a binding agreement regarding your use of and access to the Service. By accessing the website, registering for an account, and/or using the Service, you acknowledge that you have read, understood, and agree to be governed by these Terms and Conditions. If you do not agree with any part of these terms, you must discontinue use of the Service immediately.

Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.

Unauthorized Access: You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Patient Logbook Records and Data Privacy

Given the sensitive nature of the information stored within the PBO Logbook, strict adherence to data privacy is required.

Lawful Acquisition: You guarantee that all patient information you enter into the PBO Logbook has been acquired lawfully, with appropriate patient consent where required by applicable medical and data privacy laws.

Confidentiality: You are solely responsible for ensuring that your use of the Service complies with relevant healthcare privacy regulations (e.g., Data Privacy Act, HIPAA, etc.).

Data Protection: While we implement reasonable security measures to protect data stored on our servers, you acknowledge that no system is entirely foolproof. You are responsible for ensuring you do not leave your account logged in on public or shared devices.

5. Content Ownership and Intellectual Property

Your Content: You retain full ownership of the patient data, content, and records you upload or encode onto the website. You are solely responsible for the accuracy, quality, legality, and veracity of this data.

Our Intellectual Property: All rights, title, and interest in and to the PBO Logbook Service—including its software, UI/UX design, logos, and underlying code—are the exclusive property of bryanzcom. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6. Service Availability and Maintenance

The Service is designed to be available 24/7 over the Internet. However, you acknowledge that the Service may be interrupted.

Scheduled Maintenance: We may require scheduled maintenance from time to time, which will be announced on the homepage or via email in advance.

Emergency Maintenance: We reserve the right to perform emergency maintenance without prior notice to address critical issues, including but not limited to security vulnerabilities, performance degradation, and data protection.

7. Limitation of Liability

The PBO Logbook is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, error-free, or entirely secure. To the maximum extent permitted by law, bryanzcom shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, or medical liabilities arising from your use of or inability to use the Service.

8. Termination and Account Suspension

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms and Conditions. Upon termination, your right to use the Service will immediately cease.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
